If you have taken a deposit from your tenant and you instruct The Landlord Group to seek a possession against your tenant, based on rent arrears, then you really should consider including a claim in your court papers; whereby the court orders that the deposit is paid back to you and not the tenant.

It is a commonly held belief that if your tenant owes you rent that you will automatically be entitled to the deposit. You will not. Indeed, depending upon which deposit scheme you have protected the deposit in, will determine the process of how you might attempt to recover the deposit. If the tenant objects to you receiving the deposit you will probably find yourself having to attend a deposit scheme arbitration hearing to argue your case.
